1. About InfraPlan SA

InfraPlan SA is operated by COZ of Youth (Pty) Ltd, trading as We Earth FarmVision, a company registered in South Africa. The platform facilitates infrastructure planning, investment matching, TVET partnerships, and agricultural cluster development across South Africa's municipalities and communities.

2. Eligibility

By using this platform you confirm that you are at least 18 years old and have the legal authority to enter into agreements on behalf of yourself or the organisation you represent. Users representing municipalities, traditional authorities, TVET institutions, or investment entities must have proper authorisation from those entities.

3. Permitted Use

• •Submit and manage infrastructure project proposals in good faith, with accurate and complete information.
• •Explore investment opportunities and express interest in projects listed on the platform.
• •Register as a TVET institution, offtaker, DFI, or implementing agent for the purpose of genuine participation.
• •Use platform tools (maps, analytics, forms) for legitimate planning and development purposes.
• •Access and download information for internal use related to infrastructure and investment activities.

4. Prohibited Conduct

• •Submitting false, misleading, or fraudulent project information or financial data.
• •Impersonating any municipality, government body, traditional authority, or other organisation.
• •Attempting to gain unauthorised access to other users' accounts or platform systems.
• •Using the platform for commercial solicitation unrelated to infrastructure development or investment.
• •Scraping, copying, or reproducing platform content for redistribution without written consent.
• •Uploading malicious files, scripts, or content that could harm the platform or its users.

5. Intellectual Property

All content, tools, designs, data models, and algorithms on the InfraPlan SA platform are the intellectual property of COZ of Youth (Pty) Ltd or its licensors. You may not copy, modify, distribute, or create derivative works without express written permission. Project data you submit remains your property, but you grant InfraPlan SA a licence to use it for platform operations, matching, and anonymised reporting.

6. Project Submissions & Data Accuracy

You are solely responsible for the accuracy and completeness of project information, financial estimates, GPS data, documents, and photographs you submit. InfraPlan SA does not independently verify all submitted data and is not liable for investment decisions made based on user-submitted content. We reserve the right to remove or flag submissions that appear inaccurate or inappropriate.

7. Investment Disclaimer

InfraPlan SA is a facilitation and planning platform — it is NOT a licensed financial services provider, investment advisor, or fund manager. Nothing on this platform constitutes financial, legal, or investment advice. All investment decisions must be made independently with the assistance of qualified professionals. Past performance of projects or municipalities does not guarantee future outcomes.

8. Third-Party Integrations

The platform may link to or integrate with third-party services including mapping providers, document storage, and financial databases. InfraPlan SA is not responsible for the content, accuracy, or availability of third-party services. Your use of those services is governed by their own terms and policies.

9. Limitation of Liability

To the fullest extent permitted by South African law, InfraPlan SA and its directors, employees, and affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to loss of investment, loss of data, or business interruption. Our total liability in any case shall not exceed the amount paid (if any) by you for platform access in the preceding 12 months.

10. Termination

InfraPlan SA reserves the right to suspend or terminate your account and access to the platform at any time if you violate these Terms, submit fraudulent data, or engage in conduct that harms the platform or its users. You may terminate your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the platform will be subject to the exclusive jurisdiction of the South African courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or a platform notice. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
